A Motion for Contempt should be filed against the party whenever he/she has willfully refused to abide by an existing Court Order. In Domestic or Family law cases, A Motion for Contempt should or may be filed whenever a party fails to pay the ordered amount of child support or refuses to allow the other parent court ordered visitation.
